				<content:encoded><![CDATA[<p>In June 2011 50,000 tons of oil and 100,000 gallons of drilling mud were released in to the rich fishing waters of the Bohai Sea off the east coast of China. China’s State Oceanographic Administration has described the incident as, “the most serious marine ecological incident in China.”</p>
<p>The fisherman who regularly caught clams, crab, scallops and other seafood in this area saw their livelihoods destroyed by the pollution. ConocoPhillips, whose work in the area allegedly caused the spills, has agreed to pay the Chinese government hundreds of millions of dollars for the spills, but, so far, has not agreed to pay the individual fishermen anything. The Chinese Courts have also refused to hear cases and provide any relief to the injured fishermen.</p>

<p>While the numbers of people getting sick have slowed down since last fall, the risk of getting sick is not over according to the U.S. Centers for Disease Control and Prevention (CDC). According to a CDC Health Update issued in March 2013, the CDC continues to receive reports of fungal infections related to the allegedly tainted pain shots. The plaintiff in the case alleges that Intuitive Surgical marketed the da Vinci robot to physicians but failed to provide adequate trainings to those physicians. The judge found that Washington State’s product liability laws require the manufacturers of medical devices to properly train physicians who buy their medical devices, but did not rule on the merits of the case. Specifically, this well regarded physicians group said that expertise with equipment such as the da Vinci robot is limited and that surgeons who are learning how to use this new technology may have higher rates of complications than they do when using other minimally invasive and lower cost surgical methods.</p>
<p>Intuitive Surgical, the manufacturer of the da Vinci robot, defended the product saying that it is safe for patients seeking hysterectomies. Some doctors also defended the use of the da Vinci robot.</p>
<p>However, according to Bloomberg News, the number of da Vinci robot surgeries resulting in injuries and deaths reported to the FDA are rising. In 2009, 24 injuries and 11 deaths were reported. In 2012, 115 injuries and 30 deaths were reported.  The FDA says that these numbers just mean that the da Vinci robot was used in a surgery that resulted in an injury or death and not that the robot caused the injury or death.</p>
