Fungal Meningitis Risk Has Slowed But Not Stopped

Intuitive Surgical Loses Bid to Throw Out Da Vinci Robot Lawsuit

Late last month, a Washington Court rejected Intuitive Surgical’s motion to throw out a lawsuit against it and ruled that a case against it could proceed. The plaintiff in the case alleges that Intuitive Surgical marketed the da Vinci robot to physicians but failed to provide adequate trainings to those physicians. The judge found that Washington State’s product liability laws require the manufacturers of medical devices to properly train physicians who buy their medical devices, but did not rule on the merits of the case. The lawsuit is currently set to begin trial later this month.

American Congress of Obstetricians and Gynecologists Issues Warning About Robotic Surgery

The American Congress of Obstetricians and Gynecologists recently made a statement indicating that robotic surgery doesn’t improve surgical outcomes for patients and should not be the first choice for women who need hysterectomies. Specifically, this well regarded physicians group said that expertise with equipment such as the da Vinci robot is limited and that surgeons who are learning how to use this new technology may have higher rates of complications than they do when using other minimally invasive and lower cost surgical methods.

Intuitive Surgical, the manufacturer of the da Vinci robot, defended the product saying that it is safe for patients seeking hysterectomies. Some doctors also defended the use of the da Vinci robot.

However, according to Bloomberg News, the number of da Vinci robot surgeries resulting in injuries and deaths reported to the FDA are rising. In 2009, 24 injuries and 11 deaths were reported. In 2012, 115 injuries and 30 deaths were reported. The FDA says that these numbers just mean that the da Vinci robot was used in a surgery that resulted in an injury or death and not that the robot caused the injury or death.
